The BODELL BOVÉ LLC construction practice includes the representation of developers, contractors, subcontractors, suppliers, and construction product manufacturers and retailers. We have experience in all aspects of construction-related litigation, including design and construction defects, business interruption, earth movement claims, job-site injury claims, and building product claims. The projects for which we have been engaged include residential developments, commercial buildings, governmental buildings, airports, bridges, and correctional facilities.
In recognition of the fact that construction litigation can be protracted and expensive, we are dedicated to providing cost-effective representation to our clients. Our construction practice attorneys have extensive trial and arbitration experience in both state and federal courts and before the American Arbitration Association and other arbitration forums. We are a strong proponent of alternative dispute resolution when appropriate, and our construction practice attorneys have served as arbitrators, mediators, and special masters. Consistent with the group’s emphasis on cost-efficiency, each client’s goals are carefully reviewed, and a litigation plan is prepared and budgeted as requested by the client. Our coverage practice is routinely consulted on risk transfer issues which frequently arise in these matters. Specific litigation strategies are developed after the client’s goals are considered, and the most efficient and cost-effective manner of proceeding is determined.
Our construction practice group is also actively involved in construction dispute avoidance counseling on behalf of clients. This involves the review and negotiation of contracts and indemnification clauses in order to minimize risk, as well as negotiation and anticipatory dispute resolution to prevent litigation.
